Port reception facilities for the delivery of waste from ships

Four implementing regulations of 21 January 2022 lay down the rules for the application of the Directive (EU) 2019/883 of 17 April 2019 on port reception facilities for the delivery of waste from ships (PE and Cons. EU, dir. (EU) 2019/883, 17 April 2019; V. Publication of the Directive on port reception facilities for the delivery of waste from ships in the EU).

• The implementing regulation (EU) 2022/89 lays down the rules as regards the method to be used for the calculation of sufficient dedicated storage capacity.
• The implementing regulation (EU) 2022/90 pertains to the detailed elements of the Union risk-based targeting mechanism for selecting ships for inspection.
• The implementing regulation (EU) 2022/91 defines the criteria for determining that a ship produces reduced quantities of waste and manages its waste in a sustainable and environmentally sound manner in accordance with the Directive.
• The implementing regulation (EU) 2022/92 lays down rules as regards monitoring data methodologies and the format for reporting passively fished waste.

These regulations entered into force on February 13 2022.

Guadeloupe’s waste treatment plan approved by the prefectoral order 2014-209 of 25 August 2014 is currently being updated. It will take into account the amendments made to the European Directive 2019/883 of 17 April 2019, the ruling 2021-1165 of 08 September 2021 which transposed the Directive, the decree 2021-1166 of 08 September 2021 which transposed the Directive (EU) 2019/883 and the orders in the process of being signed.

Reminder:
The applicable regulations as regards port calls in Guadeloupe are observed in accordance with this Ship-Generated Waste and Cargo Residues Handling plan.

The procedure requires ship captains to upload prior notification of waste delivery (at least 24 hours before arriving to the seaport) to the VIGIEsip ‘port community’ information system used for processes involved in port calls. This applies to both ship-generated waste and cargo residue.

If the ship captain requests waste collection, the ship’s agent will place an order for removal of the waste with a port-approved service provider. (Two service providers for solid waste, one for liquid waste).

The latter will provide one or more skips depending on the type of waste to be collected.

If there is no waste to be delivered, the ship will provide proof of waste delivery at the previous port call.

Based on the provided proof (a delivery slip from the previous port or from a local service provider), the port authority will issue the ship agent a document validating the waste delivery for customs purposes.

A fee will be charged to any ship that does not provide the necessary proof.
